Terms of Service

for the Use of the App “Physique Forge X”

Welcome to Physique Forge X

Before you start building your strongest self, please take a few minutes to carefully read these Terms of Service (the “Terms”).

These Terms form a legally binding agreement between you and Barlize UG (haftungsbeschränkt) regarding your access to and use of the Physique Forge X mobile application and all related features and services (collectively, the “Service”).

These Terms, together with our Privacy Policy and any additional terms presented within the App (collectively, the “Agreement”), govern your use of:

  • The Physique Forge X mobile application (the “App”); and
  • All tools, features, AI functionality, subscriptions, and content available through the App.

By downloading, installing, accessing, creating an account, purchasing a subscription, clicking “I Agree,” or otherwise using the Service, you confirm that:

  • You have read and understood this Agreement;
  • You agree to be legally bound by it;
  • You are at least sixteen (16) years old;
  • You are legally capable of entering into a binding contract under applicable law; and
  • You are not prohibited from using the Service under applicable laws.

You are responsible for activities that occur under your account, unless such activity results from circumstances beyond your control.

If you do not agree, you must not use the Service.

1. Scope of Application

These Terms of Service govern exclusively your access to and use of the Physique Forge X mobile application and the services made available within the App.

They do not apply to other products, services, or online platforms operated by Barlize UG (haftungsbeschränkt), including the Barlize online shop, unless expressly stated otherwise.

3. Distribution and Platform Terms

The App is made available exclusively through authorized distribution platforms, including the Apple App Store and potentially Google Play (“Distribution Platforms”).

Your download, installation, purchase, subscription management, and payments are also subject to the terms of the respective Distribution Platform.

In case of conflict:

  • Platform terms govern billing, payment processing, and refunds.
  • These Terms govern your legal relationship with the Company.

4. Data Processing

Your personal data (including health-related data) is processed in accordance with our Privacy Policy.

We use third-party service providers (including hosting and infrastructure providers) to operate the Service. Details are described in the Privacy Policy.

5. Eligibility

The Service is intended for individuals 16 years of age or older.

If you are 16 or 17, you confirm that you have obtained parental or legal guardian consent.

We do not knowingly permit use by individuals under 16.

6. Description of the Service (Freemium Model)

Physique Forge X provides digital fitness and nutrition tools designed to support muscle-building and training optimization, including:

  • Fitness profile tracking
  • Workout frequency planning
  • Meal logging and nutrition tracking
  • Calorie calculator:
    • Manual food search
    • AI-based food photo estimation
    • Barcode scanning
  • AI-generated personalized recommendations (which may include weekly plans)

The Service operates on a freemium model:

  • Free Tier – limited features
  • Paid Tier – subscription-based advanced features

We may modify features, structures, or availability at any time.

7. Health Notice and Medical Disclaimer

Physique Forge X is built to support your training journey — not replace professional healthcare.

The Service provides general fitness and nutrition information for educational purposes only.

It does not:

  • Provide medical advice
  • Diagnose conditions
  • Replace consultation with a physician

Before beginning any exercise or nutrition program, consult a qualified healthcare professional.

Use at Your Own Risk

Physical activity and dietary changes carry inherent risks.

You assume full responsibility for your use of the Service.

Stop immediately if you experience pain, dizziness, shortness of breath, or discomfort.

The Service is not designed for clinical diet supervision or eating disorder management.

The Service provides general fitness and lifestyle information only.

No medical analysis, health assessment, or diagnostic evaluation is performed.

8. AI Features Disclaimer

Our AI tools are designed to support your training decisions, not make them for you.

You acknowledge:

  • AI outputs may be inaccurate or incomplete
  • AI outputs are informational only
  • AI outputs are not medical or professional advice
  • You remain responsible for how you apply recommendations

We do not guarantee specific results (e.g., muscle gain, weight loss, performance improvements).

9. Food Photo & Barcode Disclaimer

Food photo calorie estimates are approximate and may vary due to:

  • Portion size
  • Ingredients
  • Hidden oils/sauces
  • Lighting conditions
  • Database limitations

Barcode data may rely on third-party databases and may be incomplete or outdated.

You remain responsible for verifying nutritional accuracy where needed.

10. Subscriptions and Payments

Paid features are purchased via Distribution Platforms.

Billing, renewals, cancellations, and refunds, are governed by the respective platform’s policies.

We do not store payment card details.

There is currently no free trial.

11. Intellectual Property

All intellectual property rights in the Service belong to the Company or its licensors.

You receive a limited, personal, non-exclusive, non-transferable, revocable license for personal, non-commercial use.

12. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not legally permitted.

We are fully liable in cases of:

  • Intentional misconduct
  • Gross negligence
  • Injury to life, body, or health
  • Liability under mandatory statutory provisions (including product liability law)

For slight negligence, we are liable only for foreseeable damage typical for this type of contract and only where an essential contractual obligation (Kardinalpflicht) has been breached. Essential contractual obligations are those whose fulfilment is necessary for the proper performance of the Agreement and on whose compliance you may regularly rely.

To the maximum extent permitted by law:

  • We are not liable for injuries, health effects, or damages resulting from exercise activities, dietary decisions, or training programs performed based on the Service.
  • We are not liable for decisions made based on AI-generated outputs.
  • We do not guarantee fitness results, muscle gain, weight loss, performance improvement, or any specific physical outcome.
  • We are not liable for inaccuracies in calorie estimations, barcode databases, or image-based food analysis.
  • We are not liable for service interruptions caused by third-party providers, including hosting or infrastructure providers.

You acknowledge that physical training and nutritional changes inherently involve risk, and you assume full responsibility for your use of the Service.

13. Governing Law

These Terms are governed by the laws of Germany.

Mandatory consumer protection laws of your country of residence remain unaffected.

For merchants, jurisdiction is Berlin, Germany.
